On guiding assessment of strategic environment, environmental impact and environment protection commitment.1. Scope of regulation1.1. This Circular provides guidance in details on implement numbers of content of assessment of strategic environment, environmental impact and environment protection commitment promulgated in Law on Environment Protection dated November 29th 2005 and Decree no. 80/2006/ND-CP of August 9th 2006, detailing and guiding the implementation of a number of articles of the law on environmental protection, consists of: a) To prepare and review environmental impact assessment reports; b) To prepare, review and approve environmental impact assessment reports; additional environmental impact assessment reports; implement and inspect the conduction of environmental protection contents set forth in environmental impact assessment reports, additional environmental impact assessment reports and requirements of approved decision; c) To prepare, register and confirm environmental protection commitment; 1.2. This Circular shall not be applied to agencies in operation (as called on-going agencies), including agencies that failed to comply with regulations on preparation, review and approval of environmental impact assessment reports before. 1.3. Strategies, schemes, plans and projects which are subject to national securities and defenses or related to scope of national secret guided in other documents. 2. Objects of ApplicationThis Circular is applied to Government authorities, domestic organizations and individuals, foreign organizations and individuals having activities relating to contents set forth in Section 1.1. 3. Application of environmental standards and conditionsEnvironmental standards and conditions should be applied on process of preparation for environmental impact assessment reports or environmental protection project commitment according to environmental standards and conditions of Vietnam laws and regulations and of international Treaties that Vietnam is one of Contracting Parties.
